General Terms and Conditions of Seasonal Rental
Article 1
These general conditions of the seasonal rental agreement aim to define the terms of the rental of the accommodation “Les chalets d’Anaïs” located at 90 route du Grand-Massif, 74340 Samoëns – France – by the owner, Mr. Denis Barbier, to the tenant, for the duration and under the conditions specified herein.
Article 2 – Duration of the stay
The tenant who signs this agreement for a fixed term shall not, under any circumstances, claim any right to remain in the premises after the end of the rental period.
Article 3 – Reservations
The availability of the rental must be confirmed by the owner. The number and identity of the persons occupying the accommodation must be specified at the time of the reservation request (use of the house is limited to these individuals and must not exceed this number for insurance reasons).
Article 4 – Conclusion of the contract
The reservation becomes effective once the adult tenant has sent the owner a deposit of 25% of the total rental amount, a signed copy of the contract before the stated deadline, a signed copy of the general conditions, and a copy of a valid ID or passport.
No transfer of the rental is allowed to third parties unless approved in writing by the owner. Any breach will result in immediate termination of the rental at the tenant’s expense, and all paid amounts will remain with the owner.
No price disputes will be accepted after contract signature. Only the local tourist tax remains to be paid on-site.
Article 5 – Withdrawal period
For reservations made by mail, phone, or internet, the tenant is not entitled to a withdrawal period, according to Article L.121-20-4 of the French Consumer Code.
Article 6 – Cancellation by the tenant
Any cancellation must be notified by registered letter with acknowledgment of receipt to the owner.
1. Before arrival: The deposit is retained by the owner.
a) Less than 30 days before arrival: the full balance is due.
b) More than 30 days before: 50% of the balance is due.
If the tenant does not arrive within 24 hours of the scheduled date, the contract is void. The deposit is kept, and the balance may still be due.
2. Shortened stay: No refund. Only COVID-related cases (lockdown, restriction, positive test, contact case) allow refund upon valid justification.
Article 7 – Cancellation by the owner
The owner will refund the tenant the full deposit.
Article 8 – Arrival / Departure
The tenant must arrive and depart at the dates and times stated in the contract. Any delay must be communicated to the owner.
Article 9 – Payment of the balance
The remaining balance must be paid on arrival by cash, check, or bank transfer in the name of the reserving tenant.
Article 10 – Inventory
An inventory is done and signed upon arrival. This document serves as reference in case of a dispute. The tenant is responsible for daily cleaning. Final cleaning is charged €150. The property must still be returned clean and orderly.
Any complaint beyond 24 hours from arrival is void. Damage due to neglect is the tenant's responsibility. No replacements are allowed without owner’s approval. Inspection is done within 24 working hours of departure and damage may be charged accordingly.
Article 11 – Security deposit
A €1000 deposit is required by bank imprint, check, or transfer. Entry will be denied without it. It is refunded within 7 days if no damage is found within 24 hours. Otherwise, the tenant pays for any loss or damage, including extra cleaning.
Article 12 – Use of the premises
The tenant must ensure peaceful use of the property. Children remain under full responsibility of their guardians.
Article 13 – Capacity
Maximum capacity: 9 people. Exceeding this limit may lead to refusal of extra guests and termination of the contract.
Article 14 – Animals
Animals are not allowed. Violation of this rule may result in refusal of stay without refund.
Article 15 – Insurance
The tenant is liable for any damage and must hold valid holiday insurance. Lack of coverage results in financial liability. The owner is insured for rental risks. The tenant must report any incidents within 24 hours.
Article 16 – Property visits
The tenant must allow access for visits when requested by the owner or representative.
Article 17 – Smoking
Smoking is strictly prohibited inside the accommodation. Ashtrays are available outside.
Article 18 – Disputes
Complaints must be sent by registered mail with supporting documents within 48 hours of check-in. After this time, they will not be considered. Only the Commercial Court of Bonneville has jurisdiction.
